Claims for construction work are indispensable in construction projects and may caused by unpredictable factors such as different field conditions and frequent design changes as well as complex production procedures and interest relations among participating groups. While various claims for construction works are increasing, making a claim has been passive in Korean construction conditions because preparatory period for ordering construction work is short and making a claim may cause disadvantage. Claim which was not settled through negotiation and adjustment caused dispute and resultant delay or stop of construction work were very critical, so understanding of and efforts to cope with claim are absolutely required. Therefore this study is to draw preferred claim factors to predict and cope with construction claim by examining consciousness of participants in construction claim for the purpose of economic and rational construction.
As a result of examining and analyzing recognition of 11 construction claim types and 72 detailed factors obtained through existing research analysis and interview with apartment house construction parties in Gwangju and Jeonnam region, consciousness of constructors in Gwangju and Jeonnam region, consciousness of construction claim was highest in academic/related professionals and owners and constructors showed low consciousness, and then it is considered that damages from claim will be increased. Therefore, regular education for parties related to construction work should be conducted and understanding and change of recognition of claim and active techniques to settle claim should be enhanced.
It was found that types of claim by external factors, interference, process, field conditions, range of work, design change and owners were recognized as important and external factors, field conditions, laws and constructors among external factors of construction claims had a great influence on the whole claims. In addition, this study analyzed detailed and influential factors having significance. These are caused by short preparatory period, obscure responsibility and owner priority and claim and its damages should be minimized by extensive management and prior measures of claim factors in the progress of construction work.
Review of exact design and definition of responsibility limitation and range of work should be written for the period of ordering in order to minimize construction claims. Previous measures and foundation survey should be thoroughly conducted for sufficient understanding of field conditions and proper technique use and rational process management should be achieved.
In particular, since there are many cases of troubles caused by inappropriate consultation of major construction parts between owner and constructors or constructor's arbitrary decision and it may result in change of construction amount, there should be enough consultations between both parties. In case of construction work, since all matters are entrusted to constructor or additional construction cost exceeding original cost may incur or disputes by incomplete construction may be caused, records of consultations between owner and constructor should be kept in writing.
Besides, trend of construction claim should be examined through continuous research activities in order to inhibit claims and minimize damages caused by claim in construction field of Gwangju and Jeonnam regions where recognition of and technique to settle claim are relatively low and establishing D/B and alternatives related to claims and improving related systems should be accomplished.
