- Abstract
- The purpose of this study is to present the fundamental understanding on the juvenile delinquent's life after a second offense and to develop the substance theory regarding to his or her life pattern: inducing and substantiating of the substance theory. To verify the process in which the juvenile delinquents violate the probation and to keep the track of their lives in the post commitment, this study was conducted with references to the Grounded Theory of Strauss and Corbin(1998).
This study had been accomplished with the permission of the Juvenile Probation Offices and Welfare Institutes in ten regions. Participating subjects are from those who violated the probation and had the five months in-between from the last court-order. The material used in this study was collected from one station in Jeollabuk-do, one Jeollanam-do, one institute in Gwangju, one Gyeonggi-do, one Seoul, two Gyeongsang-do, and one Daejeon moving over the counseling and conference room.
It is assumed that the selection of participial subjects was made through the 'Convenience Sampling' and 'Purposive Sampling' with the application of Theoretical Sampling at the same time. The tools for this study include a written assent form, three voice-recorders, one camera, field diaries, data diaries and so on.
Throughout the survey, the collection of material has been made in the depth interview through the discussion including the researchers nominated by the authorities concerned-'the gatekeeper'. Before the interview, the assent from the subjects was made. The contents of the interview were recorded, made into the transcript and analyzed later with reference to the Grounded Theory. The data has been collected from June to August in 2006.
After the Open coding of Strauss and Corbin(1998)'s method, at the stage of axial coding, categorial and processional analysis was made by paradigm. And in selective coding, description of the story line was followed by the finding core category and with the inducing the relationship of the categories, the patterns were categorized to provide a conditional matrix.
In reviewing the subjects concerned, the number of applicants was forty three at first, but went down to twenty nine due to the withdrawing or stopping caused by overwhelming recording time, the situation on the day of interview. The group included twenty five boys(86%)and four girls(14%) ranging from fourteen to twenty, averaging 17.34. Jeolla-do accounts for 9(31%), Seoul and Gyeonggi-do, 8(27.6%), Gyeongsang-do, 10(34.5%) and Chungcheong-do, 2(6.9%).
On investigation of outcoming from the Grounded theory, the final finding was the setting up of 1,421 concepts, 59 subcategories, and 14 categories from 857 statements.
After categorial analysis in terms of paradigm, the category from the causal condition in the course of juvenile delinquent's life after the violation was 'Straying into the crime' and its core phenomenon was 'Reminding in the situation'. To this core phenomenon, 'Perceived Situation' and 'Provoked Emotion' was the condition in context. The action and interactional strategies for controling this phenomenon were these : 'Realizing', 'Changing', 'Resolving', 'Escaping', 'Idling' and 'Excusing'. The arbitrational conditions for promoting and restraining strategies above were 'Being conflicted', 'Being indifferent', 'Being supported', and the last, 'Practicing'.
The process of the after-violation life was composed of four stages: 'Recognizing', 'Sympathizing with', 'Adapting' and 'Founding' Life.
The stage 'Recognizing'-starts with the process of the juvenile reminding and recognizing of the previous crime-causing situation and consists of the causal condition-'Straying into the crime' and the condition in context-'Perceived context, recalling the process of life after re-commitment. That is, the juvenile recognizes the 'Straying into the crime' and therewith the fear-the internal and external pains following.
At the next one-the 'Sympathizing with', either the youth recognizes the causal condition and one in context, and in regretting the mischief, he or she gets the support from others or remains indifferent with continuous negativity. This stage is the one that they go through for the reversion to home and society normal. And composed of the conflict and indifference coming from the relation to the circumstance, the arbitrational condition. At this stage, the juvenile come to have the effect influencing on the action and interactional strategies- 'Negative changing', 'Escaping', 'Excusing' and 'Idling' in the next stage. In other words, at this stage, as the results of response to the influential factors that have impact on life, they seem to check up the interest and support from others, cling to the present, suppress the anger and be endurable. Or try to break up the bad habit from the past.
At the 'Adapting stage', either the juvenile express their desire to try to change for the improvement or make a positive resolution through the supportive interest. Meanwhile, there's some cases in which they complain about the negative attitude toward them, excusing themselves.
At the 'Founding Stage', the juvenile make their way to find the method of life in the welcoming support or negative attitude. And some make plans for the future under the influence of action and interaction, others idle away with expectations and make wishes in vain.
The core category confirmed by the selective coding was "to come to terms with the negative experience, adapt oneself through th conflict and support and to keep practicing". With confirming the continuous relationship among the categories centered to the core category, there come four types as follows: 'Life Oriented', 'Life Depended', 'Life Unconcerned', 'Life Abandoned'.
The 'Life Oriented' is the type that after the violation of probation, the juvenile really feel sorry about their mischiefs and try to find a new way for the promising future. Despite a lot of commitment and experience of fear and worries, those belonging to this type actively endeavor to be a master of their own lives.
The 'Life Depended' is the type that rather than regret the activities found guilty, and thereby make a foundation for improvement in the future, they hold the passive and dependent attitude and seem feeble-minded. That is, they have no actual intention to do something in detail and tend to be dependent on their parents and relatives. For those of this type, there's no coming obstacles in the future but they wait for the decision of someone else.
The 'Life Unconcerned' is the type that the youth have no self-consciousness for their criminal activities after the violation. As time went by, they admitted the criminal behaviors. They didn't feel anything concerned with their mischiefs and their own future. They are like so called couch potatoes, idling away with no purposes. They got on the air of escapism, saying "I'm going to be something with time.", "It takes time." and "I don't know yet."
Those categorized into the 'Life Abandoned' type have no awareness of the crime they've committed and excused themselves by saying "I can't help it then." They usually give up almost everything, expecting time will talk in the future without even any comment on their own.
Founded on the above, this study will make theoretical contribution to the filling up the blank in the existing study for the subjects that are not easy to have an access. And through the renewal of existing method, placed is a lot of emphasis on the Grounded theory in the qualitative analysis method and on the utilizing Nvivo 7 program to organize the material in terms of analysis. For the application of welfare system, the necessity of deep understanding of it deserves special emphasis and more detailed advice and further studies are recommended.
