Abstract

The object of this paper is to explore the theoretical views about the mode of international factoring transactions used with the mode of traditional letter of credit. Furthermore after analyzing the current status of international factoring trades this paper will suggest a strategy to enhance these trades.

Despite being in use for 30 years, factoring is sluggish in Korea even though it is popular in advanced countries and growing more so in developing nations. In Korea, several capital companies discount, in the name of factoring, p-note based on an account receivables with recourse basis. As for international factoring, Korea Export Import Bank is the only Bank engaged in export factoring among the nation's financial institutions.

This paper examines the problems of Korea's factoring system with regards to the legislation, managements, and biased emphasis on major companies, and also proposes a strategy for the expansion of factoring system uses based on these problems.

First, a plan for modifying Korean laws concerning the institutionalization of factoring companies and receivables law system is suggested as a way to enhance the factoring system uses.

Second, this paper explores ways to overcome management obstacles and create a rational management system, such as establishment of factoring financial companies via special law and providing an institutional strategy for the training of professional agents of credit investigation and debts collection.

Finally, this paper suggests methods of supporting small businesses, such as starting special financial programs, expanding non-recourse factoring, approving security right of account receivables and movables, and improving small business' awareness of factoring.
