중국 비행청소년 보호관찰제도 도입방안에 관한 연구

Abstract

본 연구에서는 중국 비행청소년 보호관찰제도의 도입방안을 모색해 보기위해 법제도적 측면과 운영측면으로 나누어 분석해 본다. 먼저 법제도적 측면에서는 중국 비행청소년 관련제도를 중국 소년사법제도, 미성년범죄형벌제도, 집행유예와 가석제도, 사회내처우제도 등에 대해 분석해 본다. 다음으로 운영측면에서는 소녀법정, 미성년자 수용시설 등을 중심으로 분석해 본다. 본 연구에서는 이러한 분석결과를 토대로 문제점을 도출한 다음 도입방안을 모색해 본다. 본 연구는 주로 문헌연구에 토대를 미루어졌다. 참고한 문헌으로는 한국 문헌, 한국 법무부통계자료, 전주보호관찰소 자료 등이었다. 이 논문은 이상과 같은 방법을 통하여 총 5장으로 구성하였다. 제 1 장에서는 연구목적, 연구방법, 연구의 범위에 대해서 기술하였다. 제 2 장에서는 보호관찰제도의 기초이론으로 보호관찰제도의 의의, 기능과 주 업무내용에 대한 개관 등을 살펴보았다. 제 3 장에서는 외국의 보호관찰의 동향과 한국의 보호관찰제도 에 대하여 살펴보았다. 제 4 장에서는 중국의 보호관찰 관련제도의 운영현황은 어떻게 되는지, 그리고 문제점은 무엇인지를 법제도 측면, 운영 측면과 보호관찰의 내용 측면으로 고찰하였다. 제 5 장에서는 제3장에서 고찰한 점에 따라 중국 보호관찰제도의 도입방안을 모색하였다. 제 6 장에서는 이상에서 논의된 내용을 종합적으로 정리하여 결론을 제시하였다.|The problem of the juvenile delinquency are more becoming ferocity, systematization and sophisticated forms day by day in China. Juvenile delinquency problem has been with the environmental pollution problems, a common drug problem has become the China's three major pollution problems. And the most serious problem is the increase of juvenile second offenders because of the influence of traditional notions and “defense”light“education” not focusing on the perpetrators of particularly young people who have run afoul of the law to protect the social return, the resumption of correction, with the result that recidivism, recidivism phenomena exist in large numbers. In order to resolve the juvenile delinquency questions of China to explore a solutiong. Ideas and learn from the advanced system, in light of China's actual situation, to create scientific, humanity's illegal juvenile's correctional system. My basic philosophy is the prevention of juvenile delinquency "education first, punishment second," "education, probation, saving". The system with the idea of protecting Juvenile have a natural consistency. So the delinquent juveniles should be protected when the Department of Juvenile Justice dealt with these cases. It is easy to make them into a worse plight because the system of the juvenile justice is too simple. In order to rectify the delinquent juveniles and orientate them towards the healthy life the paper tries to analyze the limitations from the system of Juvenile Justice in China. Action to protect democracy and the intrinsic nature of the venial and juvenile delinquency is a natural counterpart, and the development of juvenile justice in line with international trends, therefore, establishment of a system with Chinese characteristics, China's protection and the prevention of juvenile delinquency correction will have historic significance. The probation system for juvenile delinquents, therefore, is in accord with the ideology of juvenile justice. The ideology of juvenile protection aims to bring up the juvenile delinquents soundly by correcting the soundings of delinquent juveniles which could be harmful for them. The probation system is about how to treat juvenile delinquents effectively so that it can be the best way to lead them tp the right way of their lives if it is carried out in the protective and educational manner. So we can learn from it connected to the reform or improvement of the probation system in criminal justice system of China. At the same time the paper focus on the system of Probation in Korea which had carry out it for 20years with excellent results. The author introduced the system of Probation in Korea from the policy and program. In addition to give the diagrams to analyze the excellent results. As a student of social welfare, the author paid more attention to the problem of the juvenile delinquency and wanted to find the system or program that could be rectify the system of the delinquent juveniles.
