Abstract

As young people are our future and their behaviors will have a great influence on our society, juvenile delinquencies should not be neglected to prevent them from being criminals, possibility of habitual crimes should be prevented completely and their delinquencies should be discriminated from adult crimes. In the past, our society preferred to have facilities for delinquent juveniles in correctional institutions, but these days, they are helped to have normal life in their community after they get through a certain period of custody. Therefore, we have to make a deliberate consideration in treatment of juvenile crimes and prevention of second offense to help young criminals have ability to adapt to their community and cooperate with it and become its healthy members. This study speculates probation system for juvenile delinquencies based on the problems above to present standards to decide what should be done and how for their return to their community. Through legal and institutional studies on probation system, it identifies general problems and prepares effective improvement programs, which will match with basic intents of the current probation system and contribute to its further development. For the purpose, this study intends to emphasize seriousness of juvenile delinquencies and recognize it as more than a simple crime. Based on thorough examination of the concept, purpose and function of probation system, this study presents its problems and improvement programs. The current probation system has many new systems tested and diversified facilities and programs needed for its management. It is believed that the introduction of treatment in community opens a new door to the treatment of criminals through it still has many problems. Specifically, there are few human resources who are engaged in treatment in community and independency of organization of the probation institutes has not been established yet. Such basic problems are obstacles to implementation of other institutions. In addition, there are many side-effects in introduction of advanced techniques as they are not matched with our reality. Though it has many problems, the probation system is recognized to induce attention and cooperation from community in preventtion of second offense and treatment of delinquencies as well as decrease many evil practices of treatment in community and expenses, and prevent delinquent juveniles from being branded as criminals. If the probation system which has many advantages is actively used for treatment of criminals, it is expected that it will contribute to confirming return of delinquent juveniles to their community.
