Abstract
The purpose of this study is to analyse how statues relating to children with disabilities have been changed and examine the current status of educational rights of the children with disabilities at schools to present future developmental plans.
To achieve the goals, this study focuses on the following questions:
First, how the statutes relating to educational right of the children with disabilities have been changed from 1977 to 2007 ?
Second, how many educational opportunities for the subjects of special education regulated by the statutes have been realized?
Third, how much quality in the special education method regulated by the statues has been improved ?
The results of the analysis are presented as follows:
As a result of examining the transitional process of the statutes relating to the educational right of special education, legal rights even for the subjects who have not had benefits from special education have been assured in various ways. However, as most of them have specific enforcement ordinance and rules and are limited to formal and declarative regulations, public education for the disabilities and substantial special education have not been provided yet.
Therefore, this study is to present the following suggestions:
First, to assure complete educational opportunities for the disabilities, this study suggests that we should pay attention to the followings : exact identification of the current status of the subjects for special education, new establishment of special schools and class, decrease in the number of students a class, and development of supportive systems of early and advanced education.
Second, to improve quality of special education, this study suggests that we should plan and implement individualized education, develop curative support systems, support more substantial and specific integrated education, and reinforce job and transfer education that emphasizes transfer from school to society.
