Abstract
Financial crisis of 1997 brought out merge associations on a large scale in Korea. To gain financial supports from IMF, the Government introduced merge associations, accepting the needs of flexibleness of labour market. At the same time, it started reforming of the Labour and Employment Law. As a result, lay-off and time flexibility of labour were introduced through the revision of the Labour Standards Act, and dispatching of labourers was legitimated by the Act of Protection for Dispatched Labourers. This gave rise to changes of labour system of our country, especially a remarkable increase of irregular workers.
The increase of irregular workers exacerbated imbalances and conflicts of power and income gap among employed workers, which made it difficult to claim the rights of forming and participating in labour organization because of irregular workers' vulnerability of being layed off. The aim of this study is to examine the exact size of irregular workers, the condition of their labour and the cause of its increasing, to understand the problem of irregular workers, and to suggest several ways of its improvement. This study will contribute to solving the economic, social, legal problems raised by the diversity of employments and unsteady employment and securing the stability of labour market.
The analyzation of this study is based on data, especially from 'A Study on the Populations Involved in Economic Activities' of Statistics Agency. And this study is based on the data from Korea Labour Institute, Korean Labour and Society Institute, Korean Occupational Safety and Health Agency, Occupational Safety and Health Research Institute, and other labour concerned thesis and references. As the way of improvement of the condition of irregular workers, this study suggested the revision of the Labour Law and other relevant laws, the strengthening of supervising of the wage labour, the extended application of Social Insurance and Occupational Accident Insurance, the principle of same wage for same labour, labour stability, the change of business policy and legislation related to dispatched labourers, forming the research infrastructure for the decision-making of policy and its assessment.
This study has significant meaning in that it examines the way of improvements for the problems of irregular workers in various ways. Though, it needs systematic discussion and research about how to revise the system of existing Korean labour law, which is intended or made favouring the regular workers, to obtain desired effects.
